Consignor understands that all items consigned with What Winners Wear shall be in good condition and clean prior to consignment of the item. If What Winners Wear determines that an item needs to be laundered, cleaned, or repaired to be able to sell, charges for those services will be deducted from your commission check.
Consignor agrees and acknowledges that all items to be consigned are owned by the Consignor and that there are no liens, judgments, or other encumbrances against ownership, including all right of sale or transfer of consigned items.
CONSIGNMENT CONTRACT
CONTRACT PERIOD: What Winners Wear (Consignee) will make a concerted effort to sell items for Consignor, but that What Winners Wear makes no guarantee that any items will sell in the contract period. The contract period begins the day What Winners Wear receives consigned items & ends 180 days later. What Winners Wear reserves the right to not accept any item for any reason for resale. Items should be clean and in very good condition or new condition. Consignor will receive an itemized list of all consigned items within 2 weeks of receipt.
EFFORTS TO SELL: What Winners Wear conducts research of similar items selling, photographs items, measures & describes items accurately, answers questions from potential buyers, collects funds, packages & ships items safely and efficiently. Items may be taken to horse shows or other venues and/or listed online in various sites, including eBay, Marketplace, Poshmark and others. Pricing will be determined by What Winners Wear with input from Consignor with permission to discount after the first 90 days. The best selling price benefits both parties.
PAYMENT: Accounting is generally completed in the first 10 days of the month, and if items have sold, funds will be distributed by the 15th of the month. Consignors receive 60% of the sold item, less non-refundable listing/insertion fees of $3.50 per item. (Other expenses such as cleaning, maintenance, repair, etc. may be deducted.) Payment will be made through PayPal, Venmo, Zelle, or check. It is the Consignor’s responsibility to keep What Winners Wear apprised of all address/ phone number changes and corrections.
UNSOLD ITEMS: If, at the end of the contract term, items remain unsold, the Consignee reserves the right to discount items at their discretion and/or remove them from inventory. If removed from inventory at the end of the contract period, Consignor will receive a final statement detailing any unsold items and have several options:
A) Pick up unsold items
B) Have items shipped back at Consignor’s expense
C) Have What Winners Wear donate unsold items to an appropriate club or organization
Consignor understands that unsold items will not be released to me until unpaid listing/insertion fees are paid in full. Consignor will notify What Winners Wear of option choice within 30 days of final statement date. Failure to act on Options A or B within 30 days of final statement receipt will result in unsold items becoming the property of What Winners Wear.
What Winners Wear is NOT LIABLE for loss of consigned items through fire, theft, vandalism or natural disaster. This contract overrides and supersedes all preexisting contracts with What Winners Wear. By signing this contract, I agree to all terms and certify that I own the items I am consigning with all the rights to sell such items.
